Silly EU doing its thing again. This might just mean vendors selling to the US will ask for big setup fees and smaller monthly charges. ACV going from 20k setup + 120k ARR to 120k setup and 20k ARR. Or something like that. Can't understand why they would do this and create massive uncertainty for vendors.
It is crazy to me! EU just making things difficult again:) I think all CFOs and their legal teams need to pay close attention and assess if and how it will apply to them. And then monitor it to see how scope or application changes once it’s effective
Would it be feasible to include a new provision that explicitly defines “Proportionate Charges” for the purpose of the EU Data Act and gives the vendor some economic protection?

Folks will def be more clear and pay more attention to these definitions.
But I do wonder how much contract language will protect them
